The conditions set forth herein shall govern all bookings and purchases of Tourist Products, such as organized excursions and Mini Cruises sold by Maregiglio Srl- Compagnia di Navigazione and the company Cavero Renato&C. S.r.l. through the website www.maregiglio.it and on www.minicrocieretoscana.it henceforth referred to as "portals". In order to purchase the Products sold on the aforementioned sites, it is necessary to accept the following

Definitions

Client: means the end buyer.
Product(s): Indicates travel services, such as tours, guided tours, excursions, experience transfers, hotels, ticketing services, and other tourism services purchased on the Portals

Company: indicates Cavero Renato&C. S.r.l. with registered office in Isola del Giglio, Via UmbertoI, 22 REA - , VAT no. 00944870534

Provider(s): means the Provider(s) of tourism services that form the Product.

Voucher: means the document issued that provides proof of purchase and payment for the Product(s).
Meeting point: indicates the meeting point from which the purchased tour or service will begin.

Protection of personal data

Maregiglio Srl- Navigation Company undertakes to process customer data in accordance with the Law of 2003 /196 (Data Protection Act) and any other relevant legislative provisions. The data will be used exclusively for communications regarding the portals activities, respecting the full protection of the rights and privacy of the data subjects, excluding the sale to third parties. Credit card payment data will be deposited and managed by competent banking institutions that will handle it according to their security and confidentiality criteria.

Disputes: In case of problems or complaints that cannot be resolved between the customer and company should be addressed to the

 

, reserves the right, should it deem it necessary, to initiate legal proceedings before courts in countries or cities other than Italy or from to protect its interests or enforce its rights.

Reservation and confirmation: All services are subject to availability and booking acceptance must be confirmed by Maregiglio SrlCompagnia di Navigazione-Ufficio Mini Cruises or Cavero Renato&C S.r.l. For some tours you will be asked for credit card information to store and guarantee the service.

Rates: All rates include VAT and are set by Maregiglio Srl Navigation Company based on the cost at the time of printing, so rates may be changed at any time by Maregiglio Srl- Navigation Company in case of changes in transportation and service costs.

Transaction security: All transactions take place through a secure server.

Payments: payment must be made at the time of booking. For some tours you will be asked for credit card information to store and guarantee service. We accept Visa and Mastercard.

Cancellation policies MINI CRUISES AND DAY TRIPS:

Off-line reservations to be confirmed: cancellations of reservations pending confirmation are not subject to any penalty as long as the cancellation is made at least 48h before the scheduled departure time. A deposit or credit card number may be required to guarantee the reservation.

Off-line reservation cancellation within 48h of scheduled departure time: reservations cancelled before payment is made are not subject to any penalty.

Cancellation of reservations beyond 48 hours from the scheduled departure time: are subject to the following penalties:

MINI CRUISES and DAILY EXCURSIONS

-any cancellation by the client, duly communicated in writing to: crociere@maregiglio.it, before 48 h from the start time of the excursion will not result in penalty;
any cancellation by the client, duly communicated in writing to: crociere@maregiglio.it , before 24 h (1 day) from the start time of the excursion will incur a penalty of 50% of the total cost;
any cancellation by the client, duly communicated in writing to: yacht@maregiglio.it, less than 24 h before the start time of the excursion is considered
no show with 100% penalty charge on the amount paid;
In case of postponement of the event due to adverse weather conditions, decisions of the Master of the boat and force majeure, the reservation remains valid for the dedicated day. If the client is unable to attend, we will either refund the full amount paid or issue a voucher
No-show 100% penalty on the amount paid.
Liability: Compagnia di Navigazione Maregiglio Srl is not responsible for the loss of valuables left on its boats by the client, nor for any damage caused by third parties to personal items during the tour. Maregiglio Navigation Company Srl cannot be held responsible for delays, irregularities or damage caused by third parties or forces beyond its control.

Complaints: all complaints must be submitted in writing within 24 hours after the end of the tour, to the email address: crociere@maregiglio.it. The Navigation Company will not respond to complaints received 24 hours after the end of tours.

Reservation changes: for matters beyond its control or for operational reasons, the Navigation Company may change tour routes or departure times from intermediate ports at any time, subject to timely notification by the Master of the Ship to passengers, substitute alternative services for similar type and quality.

Product Changes: If, as a result of the purchase, the Customer wishes to change the Product(s), they can contact Customer Support using the 'Contact Us' form at www.minicrocieretoscana.it or send an email to crociere@maregiglio.it. The Company will make every reasonable effort to comply with Customer's request for changes, but cannot guarantee that such changes will be made.

Special offers and restrictions: special offers are subject to availability. Any restrictions are indicated in the offer details on the Website.

FOREWORD

The Customer declares that he/she has received from the Navigation Company all pre-contractual formations referred to in Article 34 of Legislative Decree 62/2018 and in particular, for this type of contract, the following information:

The Organizer is always responsible for the proper performance of all tourist services included in the contract (Art. 42);

Travelers are provided, along with the documentation and information referred to in Article 36(8) of the Tourism Code, with an emergency telephone number or contact point details through which to reach the Organizer (Article 44);
Travelers may transfer the package to another person, no later than 7 days before the start of the package and possibly incurring additional costs (Art. 38);
The price of the excursion can be increased only if specific costs (e.g., fuel prices) increase and if expressly provided for in the contract, but no later than 20 days after the start of the package. If the price increase is more than 8% of the excursion price the Traveler may terminate the contract. If the organizer reserves the right to increase the price, the Traveler is entitled to a price reduction if there is a decrease in relevant costs (Art. 39);
Travelers may terminate the contract without paying termination fees and obtain a full refund of payments if any of the essential elements of the excursion, other than the price, is substantially changed (Art. 41(1)).

If, prior to the start of the excursion, the Professional in charge of the package cancels the excursion, travelers have the right to obtain a refund and, if applicable, compensation (Art.41, Paragraph 5);

BOOKINGS FOR MINI CRUISES AND DAY TRIPS:

Booking conditions:
After making the reservation the customer to confirm the same will have to pay 100% of the cost given the small number of available berths. After making the balance to the organizer Cavero Renato&C. s.r.l., through the purchase online at maregiglio.it or minicrocieretoscana.it will receive the e-ticket that he can show directly at the point of embarkation. In case of partial or non-payment, the organizer reserves the right to consider the reservation cancelled. (ex art 1457 c.c.) and retain the deposit as cancellation penalty.

Cancellation conditions:
any cancellation by the client, duly communicated in writing, before 48 h from the excursion start time does not incur a penalty; any cancellation by the client, duly communicated in writing, before 24 h (1 day) from the excursion start time incurs a penalty of 50% of the total cost;- any cancellation by the client, duly communicated in writing, less than 24 h from the excursion start time is considered a no show with a 100% penalty charge on the amount paid;

TRAVELER'S REPORTS: any food intolerances as well as disability situations and any other requests extra to the Organizer's standard offer must be communicated.
The Organizer is obliged to provide assistance if the Traveler is in difficulty in accordance with Article 45 CdT.
